On appeal, the Beaumont Court of Appeals found that appellants oral statement was properly admitted into evidence in that appellant was not in custody at the time of the making of the statement. The Court of Appeals also found that appellants oral statement was made after she voluntarily and knowingly waived her privilege against self-incrimination. Melton v. State, S.W.2d (Tex.App.-Beaumont, No. 09-83-057 CR, delivered March 21, 1984). We granted appellants petition for discretionary review to examine these issues.
